This policy was written in English (US). To the extent any translated version of this agreement conflicts with the English version, the English version controls.

Here at Sickk Software, privacy is just as important as quality. Our business is constantly evolving, so this document may change from time to time. You may be notified during the use of the Service of a change in the Policy, at which point we require you to read and agree to the updated Policy. This will hold true for any and all changes that are made to the Policy that change or modify the integrity or clarity of the Policy. Please come back to this page every now and then to make sure you are familiar with the latest version. Any new policy will be effective from the date it is published by us.

This Privacy Policy (the "Policy") describes the absolute relationship between you and Sickk Software LLC ("Sickk", "us", "we", or "our") and its affiliates regarding the ways in which we handle, store, record, use, or manage any information (your "Info"), including but not limited to personal information provided at your disclosure you provide or we collect through our applications (the "Service") or our websites ("Sites"). Please be advised that the scope of this Policy is strictly limited to the Info collected in the previously mentioned fashion by means of the Service or Sites. Sickk Software is not responsible or liable for the actions of any third parties, their content, use or your Info, or any products or services they may offer or provide. Any reference or link to such sites does not express our sponsorship, affiliation, support, or tie with such parties.

By using the Service you acknowledge and agree to this Policy and the handling of your Info in any manner seen fit described in this Policy. If you do not agree to this Policy, or feel conflicted with our expressed intent here in this Policy, please do not use the Service.

Information We Handle

​

As stated above, Sickk Software will collect and handle Info from usage of the Service. Our primary objectives which revolve around collecting and handling your Info are to create an account for you to use the Service ("Account"), improve upon our Service and practices, contact you, conduct research, and generate reports for internal use amongst Sickk. We manage Info by storing it on servers located and run in the United States via Apple iCloud Services through CloudKit, and may store Info on servers and equipment operated on and located in other countries.

In order to use your Account or use the Service, you must create and account by registering and providing a username, password, and valid email address. If you do not wish to disclose any of this Info to Sickk Software, kindly do not use the Service.

Professional Info

​

If you wish to submit your resume, we allow you to contact us via email at support@sickksoftware.com Subject: "Careers", where we will in turn collect your name, email address, and telephone number. This info will be used to contact you regarding your availability to meet for an interview, and your qualifications for the position or role of which you applied.

Sickk Sites

​

During your use of our Sites, your device's operating system, Internet Protocol (IP) address, access, departing, and cumulative Site time, browser type, language, and referring third party Web Site addresses may be recorded automatically. We may use such information to aid in monitoring, analyzing your use of the Service, improve, and adjust our Service. Usage of the Service may include us requesting for Info that may or may not be personal to you, including but not limited to your name, profile picture, gender, age, birthday, usernames, email address, mail addresses, and associated Social Media Profiles ("SMP" or collectively "SMPs") or third party sites.

 

This information may be used to generate and create your user profile to provide you services. Your email address may be contacted regarding your user experience with using the Service, and/or to notify you of updates, news, promotions, or announcements. This practice applies to our Customer Service (CS) as well, as through our CS we may collect and use information of which your provide. Other information that you provide such as your gender, age, and birthday may also be used to analyze and generate trends related to the Service and our Sites. Your mailing address may be used by us to send merchandise or company materials ("Items") that we would like to give to you. At any point if you would no longer like to receive these Items, you may notify us and opt-out of such services by emailing us at support@sickksoftware.com Subject: "Legal Request".

If for any reason at any time you do not agree with our handling of your Info, please suspend any and all usage of the Service.

Social Media Integration & Apps

​

Our Sites may or may not include Social Media Integration ("SMI" or collectively "SMIs"), such as the Facebook Like button, the Twitter Follow button, links, references, or tags to including but not limited to, Facebook, Twitter, LinkedIn, and Youtube. These SMIs may collect and record some or all of the Info listed under Section "Sickk Sites" above. This SMI relies on either third party hosting and Info handling or hosting directly on our Site. Any and all or your interactions with these SMIs are governed solely by the Privacy Policy of the company or party providing such integration.

iOS & Android

​

When using any of the Sickk Software games or applications on a mobile device, we may or may not collect and record certain information such as your unique device ID (persistent / non-persistent), hardware type, media access control (“MAC”) address, international mobile equipment identity (“IMEI”), the version of your operating system (“OS”), your device name, your email address (if you have connected to Facebook or Google+), and your location (based on your IP address).  This information is useful to us for troubleshooting and helps us understand usage trends.

We may collect your location based information for the purpose of providing you with the correct version of the application.  We will not share this information with any third party.  If you no longer wish to allow us to track or use this information, you may turn it off at the device level.  Please note, the application may not work properly if we are unable to tell where you are coming from (Country specific).

In addition, we shall create a unique user ID to track your use of our Service.  This ID is stored in connection with your profile information to track the Sickk games or applications you are using.

Facebook, Game Center, and Google+

​

You can log in to our Site using sign-in services (“SNS”) such as Facebook, Apple’s Game Center, Google+, or an Open ID provider. These services will authenticate your identity and provide you the option to share certain personal information with us such as your name, email address, and resume to pre-populate our sign up form. Services like Facebook give you the option to post information about your activities on our Site to your profile page.

We may or may not collect and record information through the SNS in accordance with the policies and terms of that SNS. The information we collect when you connect your user account to an SNS may include the following: (1) your name, (2) your SNS user identification number and/or user name, (3) locale, city, state and country, (4) gender (or sex), (5) birth date, (6) email address, (7) profile picture or its URL, and (8) the SNS user identification numbers for your friends that are also connected to Sickk Software game(s) or application(s). Depending on your settings in such SNS or your Sickk account, other information in your profile may be shared with other users or account holders. Also, other players will be able to see anything that you post to any public page, forum or other similarly open feature in our games, websites, products, applications, community channels, or other Services.

If you want us to delete the data we receive from Facebook, Game Center or Google+ about you, please contact us via email at support@sickksoftware.com Subject: "Legal Request".

Invite Friends

​

Sickk may or may not offer you the opportunity to invite contacts from a SNS (such as your Facebook friends) so that such contacts can be located in our games and/or applications, and/or you can invite them to join you in Sickk games or applications. Such contact information will be used only for the purpose of sending communications to such addresses. You or the third party may contact us via email at support@sickksoftware.com Subject: "Legal Request" to request the deletion of this information from our database to the extent at which we store any of this information.

Push Notifications

​

We may or may not occasionally send you push notifications through our mobile applications to send you game or application updates, announcements, and/or other service related notifications that may be of importance to you. You may at any time opt-out from receiving these types of communications by turning them off at the device level through your settings.

Game Data Collection

 

Whenever you play any of our games, we collect data about all of your interactions with the game and with the other players inside the game via log files. This information may or may not be associated with your player ID, IP address, or device ID for the purpose of providing you our Services and improving them. This data is stored within Apple's iCloud.

Alternative Collection

​

We may also collect and store information that you provide us by participating in our contests, sweepstakes, and/or tournaments ("Contests") all of which affiliate to, through, or with our Service. The requested information typically includes but is not limited to name, mailing & shipping address, country, and zip code.

This information is used to notify contest winners, award prizes or material rewards, and/or to continue to monitor, modify, and improve the Service. In the even that we use a third party service provider to conduct such contests, sweepstakes, or tournaments, that company or third party is strictly prohibited from using your personal information for any other purpose other than that which was stated in this Policy.

Analytics & Data Tracking

We use analytics tools, which may include third party analytics tools, to collect information about how you play our games. Such tools tools may use cookies or other similar tracking technologies. We may use your data to carry out research, surveys, or to directly engage with or contact you, including but not limited to sending you communications for these purposes. We may also generate reports, trends, analysis or similar services for use by us for the purposes of research or business intelligence.

Advertisements

We may feature advertising within our Service. The advertisers may collect and use information about you, including but not limited to your Service session activity, device identifier, MAC address, IMEI, geo-location information, and IP address. They may or may not use this information to provide advertisements of interest to you.

In addition, you may see our games or applications advertised in other services including but not limited to our own. After clicking on one of these advertisements and installing our application, you will henceforth become a user of the Service. In order to verify the installations, a device identifier may or may not be shared with the advertiser.

How We Handle Information

We use information collected through our Service for purposes described in this Policy or disclosed to you in connection with our Service. For example, we may use your information to:

• Create applications accounts and allow users to use our products

• Identify and suggest connections with other Sickk account holders or users

• Modify, run, and improve our Service

• Understand you and your preferences to enhance your experience and enjoyment using our Service

• Reply to your comments and questions and provide customer service

• Send, communicate, offer, and deliver products and services of which you request, including but not limited to confirmations, invoices, technical notices, updates, security alerts, support and administrative messages, promotions, rewards, upcoming events, and other news about products and services offered by Sickk and any of our selected partners;

Disclosing Information

Sickk does not share, distribute, or disclose any of your personal information except as approved by you or as described below:

• Where we have your consent to do so including all of which is stated in this Policy

• As reasonably necessary in order to provide the Services to you

• When necessary in order to carry out your instructions, including but not limited to the processing of a payment instruction where we must provide your personal information to our payment processors

• Where your data is on and of an aggregated and anonymous basis

• When you submit information as part of Contests

• As we reasonably believe is allowed by law or as is necessary to comply with any legal obligation, or in order to enforce or apply our Terms of Service and/or any other agreement with you, or to protect the rights, property, or safety of Sickk Software LLC, our users, or others

• In the event there is a sale of Sickk's assets or corporate restructuring, or as a result of a change of control of Sickk or one of its group companies, or in preparation of any of these events. Any third party to which we transfer or sell our assets will have the right to continue to use the personal and other information that you provide to us in the manner set out in this Policy.

Security

Here at Sickk, we take reasonable measures to protect your information from unauthorized access or against loss, misuse or alteration by any third party.

Nevertheless, while we make good faith efforts to store the information collected on and through the Service in a secure operating environment that is in no way, shape, or form available to the public, we cannot guarantee the absolute security of that information during its transmission or its storage on our systems, as no method of data storage, transfer, collection, or handling can be deemed 100% secure. Further, while we attempt to ensure the integrity and security of our network and systems, we cannot guarantee that our security measures will prevent third-party “hackers" from illegally obtaining access to this information. We do not warrant or represent that your information will be protected against, loss, misuse, or alteration by third parties.

Cheating, Crime & Fraud Prevention

We may use personal data that we hold to prevent cheating, crime or fraud. We may also need to pass your information to fraud prevention agencies and other organizations involved in crime and fraud prevention, such as the police, local or appropriate law enforcement agency.

Access to Personal Information

​

If your personal information is modified, you may correct, update, or delete inaccuracies by making the change while signed in to your account through account settings. If you are facing difficulties achieving such changes, or no longer desire to use our Service, you can contact us by email at support@sickksoftware.com Subject: "Account Request". We will respond to your request within 30 days.

Data Retention

We will hold your information for as long as your account is active or as needed to provide you the Service. If you wish to cancel your account or request that we no longer use your information to provide you services, contact us by email at support@sickksoftware.com Subject: "Account Status". We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

What About Children

​

We do not knowingly collect or solicit or encourage the such obtainment of personal information from anyone under the age of 13 years old or knowingly allow such persons to use the Service. If you are under the age of 13, please do not send any information about yourself to us, including your name, address, telephone number, or email address.  No one under the age of 13 may provide any personal information.  In the event that we learn that we have collected personal information from a child under age 13, we will delete that information as quickly as possible.  If you believe that we might have any information from or about a child under the age of 13, please contact us by email at support@sickksoftware.com Subject: "Under Age".
